Please review the following terms and conditions governing course bookings, student conduct, American Heart Association (AHA) standards, and website use with Ascendant CPR.
These Terms of Service ("Terms") govern your use of ascendentcpr.com, the Ascendant CPR booking portal, and training services purchased or scheduled through us. By accessing an account, submitting a registration, or purchasing a course, you agree to these Terms and our Privacy Policy. If you register another person, you represent that you are authorized to provide the registration information and to communicate the applicable terms to that person.
You consent to conduct transactions and receive records electronically where permitted by law. Electronic confirmations, acknowledgments, account notices, and signatures or affirmative actions may have the same legal effect as paper records and handwritten signatures. You are responsible for providing a current email address and phone number and for retaining copies of records you wish to keep.
You must provide accurate account information and keep your credentials and devices secure. Passkeys may be available as an authentication method and use public-key cryptography; your device retains the private credential. You are responsible for activity performed through your account unless applicable law provides otherwise. Notify us promptly if you believe your account or authentication device has been compromised. You may not attempt to bypass access controls, probe the service without authorization, interfere with other users, or misuse security features.
Course availability, prerequisites, pricing, dates, instructors, and locations are shown during the registration process and may vary by session. Unless a different arrangement is expressly stated, payment is due to secure a paid seat. Payment processing may be provided by Stripe or another disclosed third-party processor. A payment authorization or receipt does not excuse a student from prerequisites or completion standards. We may correct obvious pricing or listing errors before performance of the affected service and will provide an appropriate refund or alternative if we cannot honor a confirmed registration because of our error.
Some courses require current prerequisite credentials, pre-course assessments, online modules, course materials, physical skills demonstrations, written or practical evaluations, or other requirements. You are responsible for reviewing and completing the requirements stated for your course. Arrival, attendance, participation, conduct, and successful completion are subject to the applicable course and training-program standards. Registration and payment do not guarantee certification, an eCard, a passing score, or completion credit.
Training may involve kneeling, chest-compression practice, lifting or moving training equipment, simulated emergency scenarios, and other physical activity. Tell the instructor before participating if you need a reasonable modification or have a limitation relevant to safe participation. Students must follow instructor safety directions and may be removed for threatening, harassing, disruptive, dishonest, or unsafe conduct. Any refund or transfer after removal will be determined under these Terms and applicable law.
Where a course is an American Heart Association program, completion and credential issuance remain subject to the applicable AHA course requirements and systems. References to AHA products, courses, marks, or platforms do not transfer ownership of AHA intellectual property to Ascendant CPR or to students. AHA, Stripe, mapping services, and other third-party services may impose separate terms and privacy notices when you use their systems.
You authorize us to send communications reasonably necessary to administer your requested services, including booking confirmations, schedule changes, security notices, support replies, and credential-related messages. Optional marketing email or SMS, where offered, is governed by the consent and preference choices presented to you. Consent to optional marketing text messages is not a condition of purchase. Message and data rates may apply.
Except for third-party materials and content you lawfully provide, the website’s original text, branding, graphics, software, and other protected content are owned by or licensed to Ascendant CPR. You may use the site and course materials only for their intended personal or organizational training purpose. You may not copy, sell, publish, reverse engineer, or commercially exploit protected materials except as permitted by law or by the applicable rights holder.
We work to keep the website and booking services available, but interruptions, maintenance, third-party outages, or errors may occur. Online content is provided for course information and administration and is not a substitute for emergency medical care, individualized medical advice, or calling 911 or the appropriate emergency service. In an actual emergency, follow applicable emergency procedures and the direction of qualified responders.
To the fullest extent permitted by applicable law, the website is provided on an "as available" basis and we disclaim implied warranties that may lawfully be disclaimed. Ascendant CPR is not responsible for indirect, incidental, special, consequential, or punitive damages arising solely from use of the website when such exclusions are enforceable. Nothing in these Terms excludes or limits liability, remedies, warranties, or consumer rights that cannot legally be excluded or limited, and nothing releases a party from responsibility to the extent such a release is prohibited by law.
These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles, except where federal law or another mandatory law applies. Any dispute that cannot be resolved informally may be brought in a court with lawful jurisdiction and venue. Before filing a claim, you are encouraged to contact us so the parties can try to resolve the issue directly; this informal step does not waive a legal deadline or any nonwaivable right.
We may update these Terms prospectively as our services or legal obligations change. The effective date identifies the current version. If a provision is held unenforceable, the remaining provisions remain in effect to the extent permitted by law. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and any course-specific terms shown at checkout or registration form the agreement for the covered services, except to the extent a separate written agreement signed by Ascendant CPR controls.
